Travelers Freak Affiliate Terms of Use

As an authorized affiliate of Freak Sites, Inc., promoting TravelersFreak.com, you agree to the terms outlined in this Agreement. Please read this Agreement carefully before registering and promoting Travelers Freak as an Affiliate. By signing up, you accept and agree to these terms.

Approval or Rejection of Application

We reserve the right to approve or reject any affiliate application at our sole discretion. You will have no legal recourse if your application is rejected.

Commissions

• Commissions are paid monthly. To be eligible for a commission, the referred account must remain active for at least 31 days.
• Self-referrals are not permitted, and you will not receive a commission for your own accounts.
• Payments will only be made for completed transactions. Chargebacks or refunds will void the commission.
• At our discretion, commissions may be paid earlier upon request. However, processing times for such requests can vary.

Payment

• Affiliates can request payment once their balance reaches a minimum of $25 USD.
• Payment requests can be made every 14 days; however, payment processing can take up to 30 days. Typically, payments are made via PayPal. A valid PayPal account is required to receive commissions.

Refunds

If a customer requests a refund, any commission earned on that transaction will be deducted from the affiliate’s balance.

Termination

Your affiliate status may be suspended or terminated for the following reasons:

• Inappropriate advertisements (false claims, misleading hyperlinks, etc.).
• Spamming (mass email, mass newsgroup posting).
• Promoting illegal activities.
• Failure to disclose the affiliate relationship per FTC guidelines.
• Violations of intellectual property rights.
• Offering unauthorized rebates or kick-backs.
• Self-referrals, fraudulent transactions, or suspected affiliate fraud.

Travelers Freak reserves the right to terminate any affiliate account at any time, with or without cause.

Affiliate Marketing Program CAN-SPAM Act Compliance

By signing up, you agree to comply with all applicable laws, including the CAN-SPAM Act:

• Use accurate sender information and subject lines.
• Identify messages as advertisements.
• Include a physical postal address and an opt-out mechanism.
• Do not sell or transfer email addresses of recipients who have opted out.

Affiliate Links and Promotion

• Affiliates may use graphic and text links both online (website, emails) and offline (classified ads, magazines, newspapers) to promote Travelers Freak.
• You must not alter graphics or text provided by us unless they comply with our terms.
• You may create your own promotional materials as long as they adhere to the guidelines specified in this Agreement.

Coupon and Deal Sites

• Affiliates promoting Travelers Freak through coupons or deals must adhere to the following:
  • Do not use misleading text or unauthorized coupons.
  • Avoid bidding on branded terms such as “Travelers Freak Coupons.”
  • Users must be able to view deal details before any affiliate cookie is set.

PPC (Pay-Per-Click) Policy

PPC bidding is NOT allowed without prior written approval. This policy ensures that any PPC ads are authorized and not directly run by Freak Sites, Inc.

Liability

Travelers Freak is not liable for indirect or accidental damages (e.g., loss of revenue, commissions) due to tracking failures, database issues, or other errors.

Term of the Agreement

This Agreement is effective upon acceptance into the program and ends when your affiliate account is terminated. Changes to the Agreement may be made at any time, and continued participation constitutes acceptance of these changes.

Indemnification

Affiliates shall indemnify and hold Freak Sites, Inc. harmless from any claims arising out of the affiliate’s negligence, misrepresentation, or intentional misconduct.

Electronic Signature

By completing the Travelers Freak application process, you indicate your acceptance of this Agreement, creating an electronic signature that holds the same legal force as a handwritten signature.

Affiliate Program Overview

• Each Freak Site, including Travelers Freak, has its own affiliate program. You must join each site’s program independently to participate in that specific affiliate program.
• Commissions are only generated through properly coded affiliate links, which can be viewed on the Affiliate Dashboard.

Usage and Obligations

• Affiliates are permitted to use Freak Sites’ brand and marketing materials but do not gain any rights to these assets.
• Affiliates must not represent themselves as acting on behalf of Freak Sites or advertise directly for Freak Sites.
• Affiliates shall not engage in spam or misleading promotions.

Governing Law & Arbitration

This Agreement is governed by the laws of the State of New Mexico. Any claims or disputes will be settled by binding arbitration in New Mexico.

Modification

We may modify any of the terms and conditions within this Agreement at any time, including commissions, schedules, payment procedures, and program rules.
